These Terms of Service ("Terms") are a legal agreement between you and Christian Hidalgo Avila, doing business as CHA Bookkeeping ("CHA Books," "we," "us," or "our"), governing your use of the website and services available at chabookkeeping.com (the "Service"). By accessing or using the Service you agree to be bound by these Terms.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements. The Service is intended for business use and you agree to use it only for lawful business purposes.
You must create an account to access the Service. You agree to provide accurate and complete information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Access to the full Service requires a paid subscription. Subscriptions are billed on a recurring basis through Stripe or Square. By subscribing you authorize us to charge your payment method on the applicable billing cycle.
We accept CHA_PRO tokens on the Solana blockchain as an alternative payment method for subscriptions. By using token payments you acknowledge and agree to the following:
The Service offers optional bank account connectivity through Plaid Technologies, Inc. By connecting your bank account you agree to Plaid's End User Privacy Policy available at plaid.com. You authorize us to retrieve your bank transaction data through Plaid for the purpose of importing transactions into the Service. You may disconnect your bank account at any time. We are not responsible for any errors, interruptions, or inaccuracies in data provided by Plaid or your financial institution.
You may connect a Phantom wallet to view your CHA_PRO token balance and make subscription payments. You are solely responsible for the security of your wallet, private keys, and seed phrase. CHA Bookkeeping does not have access to your private keys and cannot recover lost wallet access. You use crypto wallet features at your own risk.
You agree not to use the Service to:
You retain ownership of all financial data, records, and content you enter into the Service. By using the Service you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you. We do not claim ownership of your business data and will not use it for any purpose other than operating the Service.
The Service is a tool to help you record and organize financial information. You are solely responsible for the accuracy and completeness of the data you enter. CHA Bookkeeping does not provide accounting, tax, legal, or financial advice. Reports and summaries generated by the Service are for informational purposes only and should not be used as a substitute for professional advice.
The Service, including its design, code, features, and content created by CHA Bookkeeping, is owned by Christian Hidalgo Avila and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.
The Service integrates with third-party services including Stripe, Square, Plaid, Firebase, Helius, and Anthropic. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHA Bookkeeping AND CHRISTIAN HIDALGO AVILA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Christian Hidalgo Avila and CHA Bookkeeping from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your account at any time if you violate these Terms or if we believe your use of the Service poses a risk to us or other users. You may terminate your account at any time by contacting us. Upon termination you lose access to the Service and your data may be deleted after 30 days in accordance with our Privacy Policy.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in California under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
